State of Maine Hotel Laws
(1) Number of Persons: Concerning the number of persons allowed in a room or cabin, the following rules apply: (a) The maximum number of persons allowed in a double bed is 2; (b) The maximum number of persons allowed in a 3/4 bed or a twin bed is 1; and (c) Except for small children younger than three years of age, each person must have his or her own bed space - sleeping bags, travel mattresses, and other similar means to house additional persons are not permitted and guests may not sleep on the floor under any circumstances. We're sorry, but we do not provide cots or rollaways of any kind nor do we provide cribs. Portable sleeping units brought by guests for children under three may be permitted at the discretion of management. Management reserves the right, at its discretion, to impose additional limitations upon the number of persons allowed in a room or cabin at any time.
(2) Pets: We do NOT accept pets. This applies both to the pets of registered guests and the pets of persons visiting registered guests. Pets are not allowed anywhere on the property at any time without the express approval of management. Pets may not remain in vehicles parked on the property over night or at any other time. These rules apply to ALL animals regardless of size or type. Exceptions are made for: (1) Guide dogs; (2) animals needed for other medical reasons IF evidenced by documentation from proper authorities supplied at the time of check-in; or (3) if approved by management due to other extenuating circumstances.
(3) Gatherings and Parties: Gatherings in groups, such as for parties, must be restricted to small numbers of people in or immediately adjacent to rooms or cabins occupied by at least one person in the group. Large gatherings in the parking lot for "tailgate" or other similar parties are not permitted. Conduct of all persons must be quiet and orderly. Loud or large parties or any other activities, inside or outside, which are likely to disturb other guests are prohibited regardless of the time of day or night. Management reserves the right to define "quite" and "orderly" as the situation may warrant, to restrict visits by non-guests at any time of the day or night as the situation may warrant, and to require unregistered visitors to provide valid picture identification.
(4) Alcohol: Alcoholic beverages may be consumed only by persons 21 years of age or older and only in or immediately adjacent to rooms or cabins occupied by at least one person providing or consuming the beverages. Except for situations where adults are accompanied by their own children or by minors for whom they are the legal guardians, guests of any age will not be allowed to consume alcholic beverages unless all occupants of the room or cabin are 21 years of age or older. More specifically, actual possession of alcoholic beverages is prohibited unless all persons present are 21 years of age or older or are accompanied by a parent or legal guardian. Management reserves the right to require valid picture indentification of all guests and persons accompanying them.
(5) Cooking:
Inside cooking is allowed only in motel rooms equipped with microwaves.
Cooking may done using ONLY the appliances provided by the establishment. Guests may NOT use any other appliances. Outside cooking is allowed only if management expressly grants permission and only in places specifically designated by management. Outside cooking is generally NOT permitted, and permission for any cooking inside or outside except through the use of the microwave provided by the establishment will generally NOT be granted.
(6) Appliances: Except for those provided by establishment, appliances used for heating of any kind (microwaves, hot plates, irons, etc.), cooling of any kind (refrigerators, etc.), or are of such nature as to require excessive electrical power or which in any way utilize external fuel (propane, etc.) are not allowed. Appliances such as computers, video equipment, telephonic devices such as fax machines, or any other device which must be plugged into a telephone or cable line, or any devices of any kind requiring excessive power consumption, are likewise prohibited. Guests may NOT, for example, disconnect the establishment's telephone or television equipment in order to connect their own. Exceptions of any kind are rarely allowed and must be specifically granted by management.
(7) Flames: The only open flames permitted are matches or lighters for lighting cigarettes. No candles are permitted, nor are any other open flames inside or outside.
(8) Smoking: We do NOT have any designated non-smoking units and therefore CANNOT provide a smoke-free environment. We do everything we can to elimate traces of smoke, but we cannot guarantee that an extremely sensitive person will not notice that there has been smoking at some prior time. We allow smoking of cigarettes inside all rooms and cabins, although we do encourage our guests to smoke outside instead if the weather permits. We do NOT permit smoking of cigars or pipes inside and the smoking of any illegal substances is, of course, prohibited inside and outside.
(9) Establishment Appliances: Appliances supplied by the establishment must be used by guests only for their intended purposes and only in accordance with the instructions provided. Microwaves must be used only to heat food and beverages deemed "microwavable" and only using containers likewise deemed "microwavable." The coffee makers, where available, may be used only to heat water. Coffee and other beverages may not be heated in the coffee makers.
(10) Riding Devices: Skateboards, scooters, or other similar riding devices may not be used on the property. Bicycles are considered vehicles and must observe vehicular rules. Bicycles may be ridden in the parking lot and driveways for the purpose of entering or leaving the property only.
(11) Ball Playing and Other Outdoor Activity: Ball playing and any other form of outdoor recreational activity are permitted only when management grants specific permission and only in places specifically designated by management. Such activity must be conducted in a manner respectful of other guests. Management reserves the right to prohibit such activities at any time and to determine what type of activity is or is not appropriate. This rule applies equally to both adults and children. Concerning the latter, children are NOT permitted to play on the property, nor on the property of adjacent property owners, nor on any adjacent streets. Parents or guardians must strictly supervise children to ensure compliance with this rule, and are encouraged to ensure that appropriate arrangements are made to have the children get playtime elsewhere. While management will not deny accommodations to guests with children, guests must nevertheless be aware of the fact that the establishment is not a satisfactory place for children to stay for a long period since there are no places for children to play and no type of playing on the premises will be tolerated.
(12) Visitors: No one except registered guests is allowed on the premises between the hours of 8:00 p.m. and 9:00 a.m. without the express approval of the management. Management reserves the right to prohibit visitors at other times as well, and to require unregistered visitors to provide valid picture identification.
(13) Public Areas: Guests and visitors must stay in the public areas. These include the specific guests' room or cabin, the walkways and grass immediately adjacent thereto, the parking lot, the driveways, and the garden. Guests are not allowed in the laundry room, the garage area, behind the motel, in the basement, or behind the cabins except in the garden, nor are guests permitted access to the property of adjacent property owners.
(14) Parking/Vehicles: Guests must supply the description and license number of their vehicle. The number of vehicles allowed is ordinarily restricted to one per room or cabin. Vehicles must be parked in the parking places designated for the guest's room or cabin. Additional vehicles must be parked where management directs. No additional vehicles may be parked on the premises without the express approval of management. Parking on the grass is not permitted.
(15) Speed Limit: Vehicles may not be driven in excess of 5 mph on the property.
(16) Damage: Guests and visitors will be held liable for any damage to motel property or the property of other guests, visitors, or management. Guests and visitors may be required to pay for such damage and may also be asked to leave the premises. Damage encompasses not only breakage per se, but also such things burns, stains, or excessive dirt.
(17) Theft or Damage: Management is NOT responsible for the loss of valuables or other items left in rooms or cabins, nor for any theft of or damage to any guest or visitor property of any kind anywhere on the premises at any time, nor can management accept responsibility for any kind of valuables under any circumstances since the establishment does NOT have a safe or vault for the storage of valuables.
(18) Phone Calls: Guest telephones are for limited outgoing local, collect, calling card, credit card, and toll free calls only. Management reserves the right to restrict the number of outgoing and incoming calls. The phones are connected to a party line shared by other guests, so the duration of calls must be limited to two minutes or fewer and excessive numbers of calls are not permitted. Guests who require extensive telephone usage for outgoing calls must use cell phones or go off the property to use a public telephone. Incoming calls are received in the main office and may not be received in guest rooms or cabins. Incoming phone calls to the main motel number will be taken from 9:00 a.m. until 8:30 p.m. and a message will be left for the guest involved. Incoming phone calls between 8:30 p.m. and 9:00 a.m. will be received by an answering machine and the message provided to the guest after 9:00 a.m. the next morning. Guests are asked to restrict the number of incoming calls, regardless of the time of day, and management will not be responsible for the timely delivery of messages regardless of the nature of the message or the time it is received.
(19) Cleaning and Supplying of Units (Non-Weekly Guests): When guests are staying more than one night, rooms and cabins must be vacated for cleaning for at least one hour each day between the hours of 9:00 a.m. and 3:00 p.m. Different cleaning schedules may be arranged as needed, and management will appreciate being advised of guests' schedules. Management must, however, be allowed full access to the room or cabin for at least one hour each day, and reserves the right to require access during specific hours. No exceptions! Note: Different rules apply to the cleaning and supplying of units occupied by weekly guests (see below).
(20) Cleaning and Supplying of Units (Weekly Guests): When guests are staying on a weekly basis at a discount rate, the following rules apply to the cleaning and supplying of the units involved: As indicated in the rules applicable to nightly guests (above), units must be vacated for at least one hour between 9 a.m. and 3:00 p.m. daily. Units will be inspected daily and the trash removed. Guests are expected to keep the rooms neat and clean. Cleaning of the bathroom plus vacuuming, dusting, and other cleaning of the main room will be done as needed, but extensive daily cleaning should not be needed and will not be done. Should rooms need extensive daily cleaning, guests will be required to keep them cleaner or will be asked to leave. Clean towels and washcloths will be supplied twice per week. Should a clean towel or washcloth be needed more frequently, it will be supplied, but under no circumstances will that be allowed to become a "daily event." Sheets will be changed on a weekly basis. Beds will NOT be made by management except when the sheets are changed, BUT guests will be required to at least neatly straighten the bedding themselves rather than leaving the bedding in a "heap." Toilet paper and soap will be supplied by management as needed. All other supplies, including coffee for the coffee makers where available, are the responsibility of the guests.
(21) Possessions: The quantity of guest possessions allowed in rooms or cabins is restricted to the amount ordinarily accompanying normal travelers. While it is expected that guests staying for a long period of time, whether weekly guests or otherwise, will have more belongings with them than nightly guests, the number of possessions brought into the room must nevertheless be strictly limited. Storage of large numbers of possessions to such an extent as to make cleaning or ingress and egress difficult will be deemed excessive. Management reserves the right to require removal of possessions if, in the opinion of the management, a unit becomes cluttered.
(22) Guest Status: Maine Motel and Cabins is a motel, not a residential establishment. No guest, regardless of the length of stay, is permitted to list the motel as a residence, nor will management under any circumstances provide documentation indicating that a guest "resides" at the motel. Additionally, guests may not receive mail at the motel without the express approval of the management. All guests, regardless of their length of stay, must bear in mind that they are motel guests, not, for example, apartment renters. Consequently, many rights and privileges that they might ordinarily have when renting an apartment will not be available to them in their status as a motel guest. Additionally, weekly guests, staying for an extended period of time at a discount rate, must bear in mind that due to the discount granted to weekly guests, some of the amenities provided for nightly guests are not available to weekly guests.
(23) Guests Asked to Leave: Any guest who is asked to leave due to a violation of the law or a violation of the rules of the establishment will NOT receive a refund of any kind under any circumstances.
(22) Identification and Age: Management reserves the right to require such documentation as it deems necessary in order to properly identify a guest and all persons accompanying or visiting that guest. Management may also require any other documentation it deems necessary to determine the financial responsibility of a guest. In the case of weekly guests, the name, address, and phone number of a local employer or some other verifiable reference will ordinarily be required. Management will deny accommodations to anyone not able to provide sufficient documentation. Indentification requirements may include, but are not limited to, sufficient documentation to determine the age of all guests and visitors. Management will deny accommodations to anyone under the age of 18, and will deny accommodations to anyone accompanied or visited by a person under the age of 18, if the person under the age of 18 is not accompanied by a parent or legal guardian. Furthermore, management will prohibit alcohol consumption by any guest regardless of age if that person is accompanied or visited by another person under the age of 21 and is not the parent or legal guardian of the person under the age of 21.
(24) Children of Guests: In furtherance of the above rule concerning "Identification and Age," no persons under the age of 18 are permitted on the premises at any time unless they are accompanied by a parent or legal guardian. Similarly, no person under the age of 18 may occupy a motel room or cabin unless a parent or guardian is occupying the same motel room or cabin. Older siblings, relatives, or friends may NOT supervise younger children regardless of the age of the older person, even if the older person is technically an adult, and children may not be supervised by "babysitters." Exceptions are rare and are granted only with the express approval of management. Management reserves the right to require appropriate and verifiable documentation before granting such approval. Management further reserves the right to determine the sufficiency of any documentation presented and, at its discretion, to reject documentation regardless of its nature. With regard to children of weekly guests, it especially important that arrangements be made so that no child is on the premises unaccompanied by a parent or guardian at any time. Children may not, for example, arrive at the motel from school unless a parent or guardian is there when they arrive. Please see also "Ball Playing and Other Outdoor Activity" above for additional rules concerning the children of guests.
(25) Other: Management reserves the absolute right to establish and enforce any other rules deemed in the best interest of the establishment and the comfort and safety of the guests. Any guests or visitors not complying with management directives will be required to leave.
Rules Applicable to
Reservations, Rates, Payment, and Cancellation
(a) Check-In / Check-Out: Check-out time is 11:00 a.m. Check-in time is between 3:00 p.m. and 8:30 p.m. unless special arrangements are made. Additional fees may be charged to guarantee check-ins before 3:00 p.m. or after 8:30 p.m.
(b) Payment: Full payment for a complete stay is due at check-in. Payment must be sufficient to cover at least one night. For stays of longer than one night, the availability of the room or cabin is guaranteed only for the length of time that payment has been made at the time of check-in. Discounts for stays of three or more consecutive days are available only if full payment for the entire stay is made at check-in. In the case of weekly guests (see "Weekly Guests" below), full payment for one week is required at the initial check-in, and, for subsequent weeks, full payment for the remaining length of the stay, up to a week at a time, must be made by 8 p.m. of the final night of the current period. No guests, weekly or otherwise, will be permitted to make partial or delayed payments. Any guest paying a discount rate based upon the length of the stay, weekly or otherwise, who cannot pay for the full period of time for which the discount is granted will be charged the regular nightly room rates instead.
(c) Form of Payment: Payment may be made in cash, by traveler's check, or by credit card (MasterCard, Visa, Discover, or American Express). Except for traveler's checks, no checks of any kind will be accepted at the time of check-in or during a stay. At the discretion of management, personal or business checks may be accepted in advance as a deposit or to hold a reservation. If payment is made by credit card, the guest must have the credit card in his or her possession and the guest's authority to use the card must not be in doubt. No discounts will be granted based upon the form of payment. (See also "Presentation of Credit Cards and Other Documentation" below.) Exceptions to the rules regarding form of payment are strictly at the discretion of management.
(d) Reservations: Either credit card information or advance payment is required in order to hold a nightly reservation. MasterCard, Visa, Discover, and American Express are accepted. Advance payment, if required, must generally be made in full, but management may allow a partial deposit to be made in some cases. Management may, at its discretion, require deposits, including non-refundable deposits where deemed necessary, at other times regardless of the form of payment. The amount of the deposit, if any, to be returned in the case of cancellation will be determined on a case-by-case basis. Deposit money will not be returned if it was specified to be non-refundable. (See "Cancellation Policy" below.)
(e) Reservations for Weeklies: Credit card information is not generally accepted in order to hold a reservation for a "weekly" (Weekly Special - Long Term Discount). Weeklies are ordinarily first come/first served. If a reservation is accepted for a weekly, advance payment by check may be required and the reservation will not be considered confirmed until the check has cleared. When advance payments are accepted in this manner, they are non-refundable unless an exception is specifically made by management.
(f) Cancellation Policy: Should it be necessary to cancel, reservations for one or two nights must be cancelled by 4:00 p.m. on the scheduled arrival date. Reservations for longer than two nights must be cancelled 24 or more hours in advance as determined by management depending upon the length of the scheduled stay. Management also reserves the right to impose cancellation fees and to establish different cancellation deadlines at busy times such as holiday weekends. Guests who make a reservation and do not cancel in a timely manner will be subject to charges up to the full amount which would have been due for the period of time reserved and may also be subject to a cancellation fee. In the event of a cancellation of a reservation being held based upon a deposit, the amount, if any, to be returned will be determined on a case-by-case basis. Deposit money will not be returned if it was specified to be non-refundable.
(g) Minimum Length of Stay: The minimum length of a stay is never less than one night, normally encompassing the hours between 3:00 p.m. one day and 11:00 a.m. the next day. Management does, however, reserve the right to require guests to reserve and pay for a minimum number of nights greater than one during such times as holidays and major events. Examples include but are not restricted to such local events as festivals, graduations, and college family weekends. Minimum numbers of nights may also be imposed for guest events such as weddings or for any other occasion or circumstance at the discretion of management. Minimums also apply to weekly guests (see "Weekly Guests" below) who must pay in full for a minimum of one week in order to be entitled to the special discount.
(h) Maximum Length of Stay: Management reserves the right to place limitations on the length of a stay. In general, units are guaranteed only for the length of time for which a guest has paid or for the length of a reservation if held by credit card. Under no circumstances will any guarantees be given which would suggest that guests may stay for an "indefinite" period of time. Stays generally referred to as "weeklies" are not normally offered. Exceptions are strictly at the discretion of management (see "Weekly Guests" below).
(i) Refunds: The amount and availability of a refund due to an early departure will be at the discretion of management. Guests renting for three nights or more who stay less than that time will be charged based upon the rate for the length of their actual stay. Cancellation fees may be imposed if the guest departs early. This rule applies to ALL guests INCLUDING weekly guests (see "Weekly Guests" below). Refunds for weekly guests will NOT be prorated based upon the weekly discount rate. In the event ANY guest leaves without notice or is required to leave due to a violation of laws or rules, no refund will be granted, nor will there be a refund of any room deposit money (see below) which may have been paid.
(j) Senior, Military, and Other Similar Discounts: Discounts are available for Senior Citizens, active or retired military (with valid military picture identification), and holders of Generations Gold cards. The discounts apply to most, but not all, units and rates. Management may, at its discretion, grant additional discounts, but will normally only grant those listed. No discounts will be granted based upon the form of payment. The normal discount, when granted, will be 10%, but that rate is subject to change at any time. Only one discount may be applied during a stay. Senior, military, and other similar discounts do NOT apply to weekly rates (see "Weekly Guests" below).
(k) Rate Changes: Rates are subject to change at any time. Additionally, management reserves the right to charge higher rates on certain days or dates, to impose a minimum number of days for which a reservation must be made, or both. In the event of a change, guests making reservations for seven or fewer days based upon a certain listed rate will be permitted to pay that amount or the new rate, whichever is lower. This exception will not apply, however, in cases where a guest was made aware of a pending or possible increase at the time the reservation was made, or where the listed rate was indicated to be "Tentative." The exception also does not apply to changes in the tax rate. (See "Lodging Tax" below).
(l) Substitution of Units: Should a requested unit become unavailable due to maintenance requirements or some other unforeseen circumstances, management reserves the right to switch a guest to a similar or larger unit, including the substitution of a motel room for a cabin or a cabin for a motel room, at no extra cost to the guest, unless a guest has specifically indicated that they will not accept a substitution.
(m) Presentation of Credit Cards and Other Documentation: As indicated under "Reservations" above, reservations may be held only if valid credit card information is supplied or if advance payment is made. In addition, management reserves the right, at the time of check-in or during a stay, to require presentation of a valid credit card and to take an impression of the card regardless of the method of payment. Management may also require any other documentation it deems necessary to determine the identity and financial responsibility of a guest. In the case of weekly guests (see "Weekly Guests" below), the name, address, and phone number of a local employer or some other verifiable reference will ordinarily be required.
(n) Room Deposits: Management may, at its discretion, require a room deposit, in an amount to be determined by management, to be paid at any time before or during the occupancy of a room or cabin by any guest, weekly or otherwise. Refunds will be given at a time and under circumstances to be determined by the management. Guests who break or otherwise damage any property will forfeit all or an applicable portion of the deposit and will be required to make up the difference if they wish to stay. Should the damage exceed the amount of the deposit, the guest will be required to pay the additional amount plus enough to cover a new deposit. Guests who are required by management to leave due to a violation of the rules will forfeit the entire amount of the deposit.
(o) Lodging Tax: All rates are subject to the Maine lodging tax as of the day of check-in. As of 01/01/2004, the tax rate was 7%, but it is subject to change. Should there be a change, the charges will be subject to the new rate in effect as of the date a payment is made, regardless of when the reservations may have been made. The Maine lodging tax applies to each and every separate payment regardless of how long a guest stays. Under no circumstances will the tax be waived based upon how long the guest, weekly or otherwise, has remained. Guests do NOT become tax free "residents" after a certain period of time.
(p) Weekly Guests: Guests who stay for an extended period of a week or more with limited daily service at a special discount rate, ordinarily defined as a "Weekly Special" rate, are known as "weekly guests" whether they stay for one week or longer. Most guests are NOT considered weekly guests regardless of how long they stay. Weekly rates are normally reserved for guests who are in the process of a bona fide relocation or are in need of temporary accommodations due to home renovations, long term business requirements, or other similar purposes. Weekly rates are not intended for people who are on vacation or are merely visiting the area for normal business or pleasure regardless of the length of time involved, although Maine Motel and Cabins does sometimes offer the "Weekly Special" rate to vacationers and other casual visitors to the area. Whether or not a guest will be considered a "weekly guest" and provided with discount rates is strictly at the discretion of management. Weekly guests must comply with all the normal rules of the establishment and are also subject to special Weekly Rules and Regulations.
